Terms of Service
These Terms of Service govern your access to and use of the BOTFAY platform, including our web application, mobile application, and related services. By registering or using BOTFAY, you agree to be bound by these Terms.
1. Acceptance of Terms
By creating an account or using the Service, you confirm that you are at least 18 years old, have the authority to enter into this agreement on behalf of your business, and have read and understood these Terms.
2. Description of Service
BOTFAY provides a unified AI-powered messaging automation platform that enables businesses to:
- Connect and manage WhatsApp and Telegram accounts in a unified inbox
- Use AI agents for automated customer responses and lead qualification
- Build and maintain a Knowledge Base to train AI agents
- Escalate conversations to human operators when needed
3. Account Registration
You must register with accurate and complete information. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. Notify us immediately at support@botfay.com if you suspect unauthorized access.
4. Acceptable Use
You must NOT use the Service to:
- Send spam, unsolicited messages, or violate messaging platform policies
- Collect data without consent or in violation of applicable privacy laws
- Impersonate others or engage in fraudulent activity
- Distribute malicious software or harmful content
- Violate any applicable laws, including GDPR and Ukrainian data protection law
- Attempt to reverse-engineer, scrape, or compromise the platform
⚠️ Violation of these rules may result in immediate suspension or termination of your account without refund.
5. Messenger Platform Compliance
When connecting WhatsApp or Telegram accounts through BOTFAY, you remain solely responsible for complying with the terms of service of those platforms. BOTFAY is not liable for any account suspension by those platforms.
6. Intellectual Property
All BOTFAY software, branding, and proprietary technology are owned by BOTFAY. You retain full ownership of your data, messages, and Knowledge Base content.
7. Payment & Subscriptions
Paid plans are billed in advance. All fees are non-refundable unless otherwise required by applicable law. We reserve the right to change pricing with 30 days' notice.
8. Service Availability
We strive for high availability but do not guarantee uninterrupted service. We are not liable for downtime caused by third-party infrastructure (Supabase, Vercel, messenger platforms).
9. Limitation of Liability
To the maximum extent permitted by law, BOTFAY shall not be liable for indirect, incidental, or consequential damages. Our total liability shall not exceed the amounts paid by you in the three months preceding the claim.
10. Termination
You may cancel your account at any time from the Settings section of the app. Upon termination, your data will be retained for 30 days before permanent deletion, unless you request immediate deletion.
11. Governing Law
These Terms are governed by the laws of Ukraine. Any disputes shall be resolved in the courts of Ukraine.
12. Changes to Terms
We may update these Terms periodically. We will notify you via email or in-app notification at least 14 days before significant changes take effect.
